Department of Education
In a press release, dated 4/06/22, the DOE announced an extension of the pause on student loan garnishments, interest accrual and collections activity through 8/31/22. This applies to the DOE as well as all Guaranty Agencies.
In a press release, dated 12/22/21, the DOE announced the extension of the pause on student loan debt repayment, interest accrual, and collections to May 1, 2022. The extension will allow the Administration to assess the impact of the Omicron variant on borrowers and their ability to restart payments on their loan. This extension applies to DOE as well as all Guaranty Agencies.

The announcement discloses this is the final extension and is being implemented to ensure borrowers are able to transition smoothly to restarting payments and the Department can continue their efforts to improve loan servicing.

In addition, in a reasonable time frame after the Department announces that the payment pause will end and before it in fact does end, Guaranty Agencies (GAs) must notify affected borrowers whose loans are still with the GA that the pause will be ending and how to prepare for repayment or collections to resume. The Department will notify GAs about the requirements for notifying borrowers about the end of the pause at a later date.

The GAs are mandated to refund all monies collected from borrowers and adjust interest rate to 0% from 3/13/20. Some GAs had already removed the suspensions effective on various dates so these records will have to be released and all payments to the agencies stopped.

New orders received from guaranty agencies will not be processed. All previous restarted guaranty wage garnishments will be stopped. Any funds ADP receives from guaranty agencies will be returned to you, which should then be refunded to the employee.
Department of Education
The Department of Education issued a press release on 1/29, referencing President Biden’s Executive Order, a reminder letter to student financial aid administrators and Studentaid.ed.gov, which shares that the suspension will be extended “at least through Sept. 30, 2021.” ADP has confirmed this date with the DOE. The DOE again shared that employers should not begin collecting on previously suspended DOE orders until a new order is received.
“At the request of President Biden, the Acting Secretary of Education will extend the pause on federal student loan payments and collections and keep the interest rate at 0%.” Please read the DOE Press Release, dated 1/21/21, for more information. While this announcement does not share an extension date, the Office of Federal Student Aid shared the following: “COVID Emergency Relief Flexibilities Extended At Least Through Sept. 30, 2021”. ADP will continue to monitor closely and share more information as it becomes available.
A Biden administration official, David Kamen, has been quoted to say that the student loan debt relief initiative is a primary priority. No specific details have been announced. ADP will continue to monitor developments and report as needed. Nevertheless, the DOE resumption of garnishment activities will not occur until a NEW ORDER is served to the garnishee.
In a Press Release on 12/4/20, Secretary DeVos announced the extension of the suspension of collections and interest accrual through January 31, 2021. The Secretary also adds that this extension allows Congress time to "determine what measures it believes are necessary and appropriate."
The Department of Education announced via press release the extension of relief to federal student loan borrowers, as provided under the CARES Act, through January 31, 2021. Please read the Press Release for more information.
The DOE informed ADP that as of 10/30/20 they have temporarily closed their payment lockbox and all mail received will be returned to the sender. They reiterate all DOE-held student loans were suspended due to the CARES Act and new orders will be issued when the suspension is lifted, which, as of this writing until further notice is 12/31/20.
The Department of Education announced via their press release that they are acting upon the President’s Memorandum. Per the US DOE:
Acting on President Donald J. Trump's Presidential Memorandum signed August 8, 2020, U.S. Secretary of Education Betsy DeVos today directed Federal Student Aid (FSA) to extend the student loan relief to borrowers initiated by the President and Secretary in March 2020 through December 31, 2020.

Department of Education
The Memorandum on Continued Student Loan Payment Relief During the COVID-19 Pandemic was signed by President Trump.
The Memorandum provides for an extension of the relief provided under the CARES Act for debtors of student loans held by the Department of Education. Specifically, under the Memorandum, payments and collection of interest for student loans held by the Department of Education would be temporarily suspended until December 31, 2020.

ADP has completed all USDOE lien records. Any payments received by the DOE after 3/13/2020 will be returned to the borrower (EE) by the agency. The DOE must validate the address they have on file before issuing refunds. If this is required, your employee will receive a letter with instructions. Any payments still in the WG system will be returned. Please refund your employee.
U.S. Secretary of Education Betsy DeVos announced that the Department will halt collection actions and wage garnishments to provide additional assistance to borrowers. This flexibility will last for a period of at least 60 days from March 13, 2020.

Tax Levy
IRS call centers are back up and operational. Employees should be able to obtain releases if they contact the number on their notice of levy.
The IRS issued a News Release, dated 7/08/20, advising taxpayers who took advantage of the People First Initiative tax relief and did not make payments between March 25 to July 15 to resume their payments by their first monthly payment due after July 15, 2020 to avoid penalties.

The IRS updated their FAQ’s on 4/20/2020 and confirmed that they are not automatically suspending existing levies unless an “economic hardship” is requested & granted by the taxpayer.

Colorado SB 20-211 was not extended and has expired as of 6/01/2021.
Colorado Senate Bill 20-211, set to expire as of 2/1/2021, that provides debtors with the option to request a temporary suspension on writs of garnishment was extended until 06/01/2021.
The enacted legislation as previously communicated allowing debtors the option to request temporary suspensions on new writs has been extended to 2/2/2021.
Colorado Senate Bill 20-211, enacted on 6/29/20, provides debtors with the option to request a temporary suspension on new writs of garnishment until 11/1/20 (or 2/1/2021, if extended). The judgement creditor provides this option with a notice included with the writ of garnishment served upon the garnishee. The debtor must contact the creditor/attorney listed on the notice to request the temporary suspension. The Connecticut Department of Revenue Services (DRS) has launched a new assistance program specifically designed to help taxpayers with outstanding collection matters who have been impacted by the COVID-19 pandemic. Wage Garnishments – Taxpayers who are under an existing wage garnishment and are impacted by COVID-19. should take advantage of the Priority One Program and contact DRS to discuss the terms of the garnishment. The Public Health Emergency previously declared by Mayor Bowser of D.C. ended as of 7/25/21.
The Mayor of D.C. passed D.C. Act 23-286 on 4/10/2020, which included amending Section 207 for Debt Collection. During the public health emergency and for 60 days after its conclusion, no creditor or debt collector will initiate new garnishments.

On March 18, 2020, the state of Georgia issued a state of emergency order prohibiting the filing of new writ of garnishments. The garnishment stay began on March 14, 2020 and was subsequently extended to July 14, 2020.

During the GA statewide suspension period (3/14/2020 – 7/14/2020), Fulton County Magistrate Court inadvertently continued to issue and deduct garnishments. The court has begun to send out notices to affected garnishment parties which may trigger additional questions. If employees need access to funds that were withheld and remitted during that period, they will need to request from the court, in writing, that they would like their case reviewed. Writs of Garnishments
The Governor’s Executive Order 2020-25, later amended by Order 2020-55, suspending the service of new garnishments has been rescinded, effective 06/25/2021.
The Governor's Disaster Proclamation previously issued by Executive Order has been extended in its entirety multiple times, and therefore, the suspension of service of new garnishments is still in effect. ADP continues to actively monitor. Although courts are open, some are not issuing Orders to Pay while the Executive Order remains in place. Accordingly, funds will continue to be on hold pending an Order to Pay.

Iowa Writ of Garnishments
Iowa’s Proclamation of Disaster Emergency, dated 4/24/2020, section 28, suspending garnishments and further addressed in the Proclamation dated 4/27/2020, section 100, indicating this section should not be expected to extend past May 27, has expired.
Per Proclamation from the Governor, Iowa wage garnishments will be suspended from 4/27- 5/27 due to COVID19. This proclamation does two things: First, it prevents the filing of new garnishments. Second, it stops any ongoing garnishments of wages or bank accounts. They are sending notices to employers and any payments after 4/27 will be returned to the employers. This suspension currently only lasts until Thursday, May 27, 2020. If this gets stay gets extended, they will notify employers

Tax Levy
Governor Whitmer signed Executive Order NO. 2020-26 due to Coronavirus COVID19. The Dept of Treasury is suspending collection on all State Tax Levies and issuing releases. They will not reissue new tax levies, and they are providing the debtor the benefit to set up a payment plan in the future to collect the remaining balances. If they debtor fails to set up a payment plan, a new Tax Levy will be issued to collect the remaining balance. Please reference the Executive Order No. 2020-26.

The Governor's Emergency Executive Order 21-21, filed May 6, 2021, indicates that upon determining that seventy percent of people sixteen years of age and older have received at least one dose of COVID-19 vaccine, the Commissioner of the Minnesota Dept. of Health will notify the Governor and the public. Effective two business days after that notification, or on Wednesday, June 30, 2021 at 11:59 pm, whichever occurs first, several executive orders are rescinded, including 20-50 and 21-02. Mississippi Department of Employment Security
Executive Order 1462 has not been extended. This order, previously suspended tax garnishments and claimant overpayment garnishments through 6/27, has expired. Employers should begin withholding.

The Supreme Court of Missouri ordered operational directives, effective May 16, to help courts statewide begin easing COVID-19 restrictions on in-person proceedings. Writs of Garnishment
Emergency Directive 017, that previously instructed garnishees to stop withholding for writs of garnishments, was terminated on June 30, 2020 at 11:59pm (see Emergency Directive 026). Garnishees should begin withholding for Nevada writs of garnishment that are still in effect (have not exceeding their withholding timeframe).
On May 1, 2020, the Nevada Governor issued Emergency Directive 017. This directive clarifies that no new garnishments shall be issued and all funds received [by the constables] during the stay will be immediately returned. In addition, section 4 of the directive shares that, “Garnishees withholding funds pursuant to a writ of garnishment shall stop such garnishments and withholdings without facing liability for failure to withhold.” This does not apply to child support, spousal support or any criminal restitution. The Directive will remain in effect until the state of emergency declared is terminated or unless renewed by a subsequent Directive.

In response to Emergency Directive 017, FSWG will suspend most Nevada writs until further notice. Since this directive does not apply to support or criminal restitution, orders that have a case ID that begins with A (district court restitution orders) and D (divorce proceedings) will remain active. If a Nevada Constable receives a payment for a lien that has been stayed, they will return the payment to ADP and we, in turn, will return the funds to the employer. Ohio Writ of Garnishments
Lorain Municipal Court issued a Court Order on 4/6/2020 indicating that any garnishment received by the clerk after March 15, 2020 would be stayed until further order of the court and any funds held by the Clerk would be released to the garnishee or defendant.

Crawford County Municipal Court filed a Judgment Entry temporarily staying all garnishments filed with this court on April 1, 2020. Franklin County is suspending issuing new orders, per Administrative Order 07-2020 effective 04/07/2020 any new garnishments filed between March 16, 2020 and June 1, 2020, the court will not issue service of the order before June 2, 2020. Lima Municipal Court in Allen County confirmed that Administrative Order 20 MISC 006 is being applied so that no new orders are being served. Tax Levy
Department of Revenue (DOR) Garnishments Department — The department has taken temporary steps to reduce the automatic issuance of garnishments. If a debtor is experiencing a financial hardship due to the COVID-19 pandemic and wages are currently being garnished by the department, debtor can request a temporary wage garnishment hold by contacting the DOR prior to June 30, 2020. Per the DOR Contact, if temporarily suspended, these cases are to be reviewed every 30 days and they will send a "Remove Hold Letter" once the pandemic crisis is over.
OR DOR has shared that if the employees basic needs are affected due to COVID-19, the employee can contact them at (503) 945-8200 and provide the company's HR fax number and they will fax the employer a "temporary hold letter".
Once COVID-19 is resolved they will determine next steps to reinstate the order.
All payments they receive will be cashed and not returned as long as the employee has a valid Tax Levy/Garnishment.
Per the OR DOR, cases are reviewed on a "case by case" basis and if they find that COVID19 affected the debtor they can allow for a 30 day "Temporary Hold" letter to be sent. It’s the responsibility of the DOR Agent to review these cases every 30 days and will send a "Remove Hold Letter" once the pandemic crisis is over.

Pennsylvania Department of Revenue (DOR)
ADP has confirmed that PA DOR started to issue new garnishments. The agency also has begun sending out revised garnishment orders on existing cases that include a letter to the employer advising of the updated garnishment ID which replaces the prior garnishment ID. The new garnishment ID is generated by PA DOR’s new system.

Texas Office of the Attorney General - Child Support

Effective 7/01/20, Utah Office of State Debt Collection (OSDC) lifted their garnishment suspension. Previously the department shared that they were issuing letters authorizing employers to temporarily suspend withholding. The UT OSDC has now lifted the suspension and has begun mailing letters instructing employers to begin withholding. Some items of note: interest accrued during the suspension period; however, the notices do not include a revised balance. If another Utah garnishment has been received during the suspension, the reinstated order will be considered second in line and does not hold its original position.

The VA Supreme Court unanimously extends the Declaration of Judicial Emergency for a third twenty-one day period, through May 17, 2020, for all district and circuit courts of the Commonwealth. Washington Division of Child Support
All Division of Child Support offices are open to the public. Customers are no longer required to wear a mask while indoors, but are asked to affirm whether or not they are experiencing any COVID-like symptoms. This screening process includes signing in on a log sheet to assist with contact tracing, if necessary. Maintaining social distancing is still in place. DCS staff, while serving clients in congregate settings, will continue wearing masks.
Payments in Child Support offices are suspended. Although our offices are now open, with the exception of the Everett office due to a fire, offices will continue to not accept child support payments.
